Synopsis

With seismic shifts underway in the data protection landscape in the UK and EU, this session will provide an overview of key developments and highlight the issues that IT practitioners will need to consider in the transfer of personal data between the EU and UK in future and recommend how to navigate current uncertainty. It will cover:

  • the ‘grace period’ or ‘bridge’ for transfers from the EU to the UK;
  • the possibility of two European Commission adequacy decisions in respect of EU to UK transfers and the latest developments, including the recent publication of draft adequacy decisions;
  • the new UK GDPR (applicable since the end of 2020) and new transitional provisions for international transfers from the UK (this time, in UK domestic law);
  • a ‘separation’ period under the EU Withdrawal Agreement in respect of legacy data; and
  • the latest developments on new EU standard contractual clauses.

About the speakers

Joanna Willems (Law (BA Hons, Cantab), LLM) is a Senior Associate in the Data Protection practice at the Top 10 Global Law Firm, CMS Cameron McKenna Nabarro Olswang LLP (CMS). Joanna is an experienced data protection and privacy lawyer and advises clients in the energy, pharmaceutical, education, financial and pensions sectors on a wide range of data protection and privacy considerations. She has advised on the data protection, privacy and information sharing elements of a range of public and private sector projects, including in respect of international transfers.

Prior to joining CMS, Joanna worked as a senior in-house lawyer for the UK Government, including on data protection and privacy law. Joanna regularly represented the UK Government in working level international negotiations, including on aspects of the EU data protection package. Joanna also previously served as Head of Office to a Member of the European Parliament and as an EU Policy Adviser to the UK Law Societies. She also acted as an adviser to the EU Committee of the Law Society of England and Wales and represented the UK Delegation in the European Private Law Committee of the Council of Law Societies and Bars of Europe.

Catherine Keeling is an Associate in the Data Protection and Technology practices at CMS. She specialises in the fields of data protection and technology transactions and regularly advises on data protection compliance in the context of a range of corporate transactions and outsourcing. She advises clients across a range of sectors including healthcare and energy and previously worked in-house on secondment at a major global telecommunications business.
