Dr. Kuan Hon has reconstructed an authoritative and compelling history and analysis of a legal idea that simply doesn't make sense in the 21st century globalised IT landscape: the "data-location fixation".

How did a well-intentioned legislative tool, originally aimed against the sabotaging of EU data protection laws via offshoring of personal data operations to service providers located outside the European Economic Area, became not just ineffective but positively damaging in other ways?

Anyone who works with data in an international context knows that physical data-location in a country is not necessarily enough to give that country effective jurisdiction and sole power to apply its laws to that data. Kuan chose to dissect this area for her PhD because IT professionals and lawyers alike kept telling her that personal data “transfer” restrictions constituted the single most problematic, box-ticking, time-wasting data protection law issue that they’d had to wrestle with.

So, what should laws, policies and practices on data "transfers" look like to counter that misplaced assumption and better protect personal data?

SPEAKER BIOGRAPHY

Dr Kuan Hon is an English solicitor and New York attorney currently focusing on data protection/security/information law, including the General Data Protection Regulation, the NIS Directive, the proposed ePrivacy Regulation, international transfers, and security/other data protection law breaches.

Additionally, she is an expert on all cloud computing legal issues and technical security matters. She joined Fieldfisher as a Director for Privacy, Security & Information in July 2017.

She was awarded an Honorary lifetime professional membership of the Cloud Industry Forum and currently serves as a i100 volunteer (part-time) at the UK National Cyber Security Centre, she has been a guest lecturer for Imperial College London (Department of Computing) since Apr 2018 and is a Visiting Scholar at the Centre for Commercial Law Studies, Queen Mary University of London until March 2020.

She became the editor of Sweet & Maxwell's Encyclopedia of Data Protection and Privacy in 2017.
